That’s why even companies that aren’t traditionally ad businesses have jumped in: e.g., Amazon uses data from your browsing and buying to serve personalized product ads and recommendations, driving more sales. And it’s not just online: data collected might inform which coupons you get in the mail or what promotions you see in-store. The quest for ad dollars leads companies to collect as much data as possible, often far beyond what’s needed for the service itself. It’s an arms race to build the most detailed consumer profiles, because that translates to $$$ in ad targeting.

  • Personalization and Engagement: Companies will tell you data collection is also about improving user experience. There is some truth to that. Using data, services personalize content to keep you engaged. Netflix’s recommendation engine analyzes your watch history to serve up movies you’ll likely watch next. Spotify does the same for music. Facebook’s algorithms learn what posts make you stop scrolling and will show you more of those. This personalization keeps us hooked – and more engagement means more opportunity to show ads or promote products. So even when not directly selling your data, companies use it to make their platforms “stickier.” However, that personalization can cross into manipulation (as discussed earlier) and often it’s optimized for the company’s benefit (more screen time) rather than your well-being. Data is the raw material used to train AI models that decide what you see. The more data, the better these models predict what will keep you around. For tech companies, data = competitive advantage. They all want the biggest dataset to develop the most compelling features, whether it’s a voice assistant that understands natural speech (needs tons of voice recordings to train on) or a map that can predict traffic (needs location data from millions of drivers). So even outside of ads, data is valued because it powers the services and future innovations. The catch is, to get that personalization, we end up surrendering a lot of privacy. Companies bank on users valuing convenience enough to overlook the data trade-off.

  • Selling Data (Data Brokers): There’s a whole shadowy industry of data brokers that most of us never interact with directly, but which might have detailed files on us. These are companies whose business is to buy, compile, and sell personal data – for marketing, credit risk assessment, people search sites, etc. For example, there are brokers specializing in location data from mobile devices, brokers for purchase histories, for public records, and so on. You’d be surprised how much is out there: voter registrations, court records, warranty cards you mailed in, subscriptions, and then all the online stuff – likely all aggregated together to form a comprehensive profile. These brokers often get data from other businesses (say a retailer loyalty program might sell your purchase data) or from scraping the web. The data broker market is huge and growing – estimated around a $240 billion industry (and projected to keep expanding rapidly). And it’s largely unregulated in many countries. That means your data can legally be sold and re-sold to pretty much anyone willing to pay. Advertisers, insurance companies, employers doing background checks, even governments, can purchase data from brokers rather than collecting it directly. This creates a data economy outside the view of consumers – you might never know which companies have info on you. The incentive for companies to collect data isn’t only to use it themselves, but sometimes to package and sell it. For instance, a weather app might sell location histories to third parties. Facebook (before it shut down some programs under pressure) used to share or barter data with partners. Even credit bureaus (Equifax, etc.) make a chunk of revenue by selling consumer data reports beyond just credit scores. So, your personal info can be monetized many times over. It’s a big reason why “data is the new oil” became a buzzphrase: an individual’s data might only be worth fractions of a penny for one transaction, but at scale (billions of data points on millions of people, constantly refreshed), it’s an incredibly rich resource.

  • Product Improvement and AI Training: Another reason companies collect data is to improve or develop products – but even this ultimately ties to profit. For example, every time you speak to a voice assistant or use a free translation service, that data can be used to improve the underlying AI models. Tech firms have been known to use customer data to train algorithms – sometimes controversially, like when it came out that Siri, Alexa, and Google Assistant all had human reviewers listening to some recordings to better the AI. Likewise, companies developing self-driving cars need reams of driving footage data. Who provides that? Sometimes it’s users. Tesla, for instance, can collect video clips from its cars on the road to help train its autonomous driving system. While this kind of data usage might not have the direct privacy harms of, say, advertising, it still raises consent and transparency issues – are users clearly aware their device usage doubles as R&D for the company? Often not. In this model, nothing is sacred: even data about your emotions or health or relationships can be fair game if it can be turned into a revenue stream. That’s why period-tracking apps, for instance, got scrutiny – some were found sharing sensitive health data with analytics and advertising firms. Or why smart TVs have been caught tracking what you watch second by second – because TV makers realized they could make money selling viewership data. The drive to maximize profit in a digital economy naturally leads companies to say, “If we can measure it, we can monetize it.” The scary part is this can create incentives against privacy. A platform that locks down data and strictly limits collection might make less money (in the short term) than one that vacuums up everything and finds clever ways to exploit it. So the market rewards the more invasive approaches unless consumers push back or regulations step in.

A 2019 survey found only about 9% of Americans always read privacy policies (and I suspect even that is people pretending they do). Who has hours to parse the million-plus words of legalese we’re confronted with? (One study estimated it would take 244 hours a year to read all the privacy policies you encounter online – about six full work weeks!) So practically speaking, “consent” via privacy policy is a farce. We click “Agree” because we want to use the service, not because we truly understand or agree with all the terms. Companies often hide the more intrusive data practices in those dense documents, or phrase them obtusely. Thus, they legally cover their bases while knowing that almost no users actually absorb the information. It’s a “big little lie” – we pretend to read, and they pretend that we read. As one FTC commissioner put it, the notice-and-consent framework is based on flawed assumptions that the info is digestible and that users have a meaningful choice. In reality, consenting to many data practices is more like a coerced formality – you can’t negotiate the terms (it’s take-it-or-leave-it), and leaving it often isn’t feasible if you need the app or site. Sure, you could refuse and not use the service, but in today’s world that might mean cutting yourself off from friends, opportunities, or information. That’s not a real choice.

  • Dark Patterns – Designing Consent That Isn’t Real Consent: Have you ever tried to opt out of something on a website and found the button cleverly hidden or the process frustratingly complex? You likely encountered dark patterns – design tricks that nudge or pressure users into doing what the company wants, often against the user’s best interest. For privacy, dark patterns are rampant. For example, a site might flash a big, shiny “Accept All Cookies” button, but bury the “Manage Settings” (to reject trackers) behind multiple clicks or in gray text. Some apps will pester you repeatedly for permissions you’ve declined, until you finally give in. Others word their choices in confusing ways (e.g., “Allow us to sell your data?” – yes/no, where a double negative or confusing phrasing might lead you to click the wrong one). The FTC has warned that companies use sophisticated dark patterns to trick people into sharing more data. This can include tactics like pre-checked boxes for data sharing, or designs that make the privacy-friendly option harder – for instance, making the “Decline” button nearly invisible or guilt-tripping you (“Allow data collection to support our service”). Some social media platforms have in the past made it difficult to find the privacy settings page at all – hardly an accident. The result is many users “consent” simply because the alternative was made too confusing or time-consuming. Regulators are catching on: California’s privacy law explicitly says consent obtained via dark patterns is invalid, and the FTC has taken action against egregious cases. But dark patterns are like a cat-and-mouse game – as people catch on to one scheme, designers come up with another. The outcome is that you might think you agreed to share data, but really you were steered into it by interface trickery. It wasn’t a free choice, it was an orchestrated one.

  • Lengthy, Vague Terms of Service: Even beyond privacy policies, the general Terms of Service for apps often include clauses granting the company broad rights to use data or even content you create. These documents can run tens of thousands of words. They’re written to be maximalist – giving the company as much leeway as possible while limiting their liability. For instance, a clause might say by using the service, you give the company a license to use your content and data for any of their business purposes (which could include, say, training AI or selling ad insights). They often mention sharing data with “trusted partners” – a nebulous term. If you tried to actually read them, you’d need a law degree and a lot of coffee. The upshot is, buried in those terms, you might be “consenting” to data uses you’d never knowingly agree to. And companies can later point and say “See, it’s in our terms that you agreed we could track your location for analytics,” etc. It feels very one-sided – because it is. Users have practically zero bargaining power in these contracts of adhesion (legal speak for take-it-or-leave-it agreements). So, saying consent was given in any meaningful sense is pretty disingenuous.

  • Opt-Out Difficulties: Let’s say you do want to revoke consent or limit data sharing – you often have to jump through hoops. Unsubscribing from data collection or deleting your data can be intentionally convoluted. For example, Facebook historically spread privacy settings across 20 different screens and menus. Some sites require you to email a request to opt out of sale of data, rather than a one-click solution. Ever try deleting an online account? We’re bombarded with so many consents and cookie notices that we just click “yes, yes, whatever” to get on with our day. A study or two have shown that users feel a sense of futility – that no matter what they do, their data will be collected anyway, so why bother reading or fighting it. This phenomenon, sometimes dubbed “privacy resignation,” is something companies count on. If users have given up, they’ll hardly complain about new invasive features. It’s telling that in one survey, 38% of adults said they sometimes read privacy policies, but 36% admit they never read them at all. Many of those who do read them say they don’t understand them well. So the system conditions us to be desensitized. Beyond the money, the settlement forced Facebook to implement new privacy oversight mechanisms and required personal accountability from executives for future privacy compliance. Google has been fined multiple times by European data protection authorities (e.g. €50 million by France early on for insufficient transparency, and more recently hundreds of millions combined for various consent issues and ad personalization violations). Even Facebook (Meta) and its subsidiaries like WhatsApp have faced big fines in the EU for things like lack of valid consent and inadequate disclosures. These fines make headlines and aim to deter bad behavior. While big tech companies often appeal them (and sometimes get reductions), the message is clear: misuse user data in Europe and face hefty penalties. There have also been landmark court cases in Europe like Schrems II, which invalidated EU-US data transfer frameworks over surveillance concerns – showing that individuals (in that case privacy activist Max Schrems) can successfully challenge corporate and government data practices. GDPR also empowered consumer groups to launch collective actions. All this legal activity is slowly forcing companies to reform how they handle data – at least for European users.

  • Lawsuits Over Spying Devices and Apps: Closer to consumers, we’ve seen class-action suits and state attorney general actions. For instance, multiple lawsuits were filed against Ring (owned by Amazon) after creepy instances of hackers breaching home security cameras and terrifying homeowners – raising questions about Ring’s security and privacy practices. Privacy Laws Today: GDPR, CCPA, and the Push for Stronger Protections

We’re still in relatively early days, but some laws are making a difference and serve as models for others.   • GDPR (European Union, 2018): The General Data Protection Regulation is often considered the gold standard of privacy law right now. It grants EU residents robust rights over their personal data – the right to access data companies have on you, the right to correct it, delete it (the “right to be forgotten”), the right to data portability, and to object to certain processing. It also requires companies to get clear consent for many data uses (no more pre-ticked boxes), mandates disclosure of data practices in plain language, and imposes strict requirements for data security and breach notification. GDPR has extraterritorial reach, meaning even companies outside Europe must comply when handling EU residents’ data. Importantly, it has teeth: fines up to 4% of global annual revenue. However, critics point out that the Act gives significant exemptions to government bodies and lacks an independent regulatory authority like the EU's GDPR. While not perfect, it marks a big step forward in recognizing data privacy as a fundamental right in India—following the Supreme Court's 2017 judgment declaring privacy a constitutional right. As India’s digital economy explodes, the success of this law will depend heavily on enforcement, transparency, and public awareness.

    Do We Need Stronger Laws?

    Many experts say yes. Even GDPR, with all its strengths, hasn’t stopped the underlying business model of surveillance-driven advertising. There’s also the issue of enforcement resources – some big tech companies treat fines as a cost of doing business. Privacy advocates argue we need laws that minimize data collection by default (data minimization principle) and maybe even new approaches like data trusts or fiduciary duties (where companies must act in the user’s best interest with the data). There’s also a call to give people not just rights on paper but easy-to-use tools to exercise them – like a universal browser setting that signals “Do Not Track” or “Don’t sell my data” (actually such signals exist but not all companies honor them unless required). Fundamentally, we might need to ban certain particularly egregious practices (for instance, many support outlawing the sale of location data by brokers, given the potential dangers like stalking or surveillance of sensitive locations).
